Mr. RD Rattewal, Advocate for the respondent. *** ANIL KSHETARPAL, J (Oral) The hearing of the case was held through video conferencing on account of restricted functioning of the Courts. Through this application, the petitioner (wife) prays for transfer of petition bearing No.GW/3/2021 (Harmesh Lal vs. Suveena Rani) pending before the Court of Principal Judge, Family Court, Samrala, District Ludhiana, to the Court of the District Judge, Family Court, SBS Nagar. It has been brought to the notice of the Court that the respondent is already defending two cases at SBS Nagar. The first is petition under Section 125 Cr.P.C. whereas the second is the petition under Section 13 of the Hindu Marriage Act, 1955, which were filed in August, 2020.

The respondent has subsequently filed a petition for custody of his minor children who are also residing with the wife at SBS Nagar. Keeping in view the aforesaid facts, the petition is allowed. The file of case bearing No.GW/3/2021 (Harmesh Lal vs. Suveena Rani) pending ASHOK KUMAR 2021.08.

TA-526-2021 (O&M) before the Court of Principal Judge, Family Court, Samrala, District Ludhiana, is ordered to be transferred to the District Judge, Family Court, SBS Nagar. The transferor Court is requested to remit the case file to the transferee Court forthwith. The parties are directed to appear before the District Judge, Family Court, SBS Nagar, on 10.09.2021 who will either decide the matter himself or assign it to the Court of competent jurisdiction at SBS Nagar.

All the pending miscellaneous applications, if any, are also disposed of.
