Naresh Kumar Sanghi, J.(Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Ankit Bagga, who has been booked for having committed the offences punishable under Sections 354-D and 506, IPC, and Section 67-A of the Information Technology Act, 2000, in a case arising out of FIR No.18, dated 03.10.2015, registered at Police Station, Women Gurgaon, District Gurgaon.

Learned Senior counsel submits that the petitioner, who is a young boy of aged 26 years, is behind the bars for the

[2] last about one month; the offences for which the petitioner have been booked are exclusively triable by learned Judicial Magistrate Ist Class; the investigation qua him is almost complete; and further incarceration of the petitioner would not be of any consequence. He further submits that the petitioner undertakes not to repeat the offence during pendency of trial. Learned counsel for the State has not controverted the fact that all the offences for which the petitioner are booked are triable by learned Judicial Magistrate Ist Class and that the petitioner is behind the bars for the last one month. He further concedes that the petitioner is neither required nor involved in any other case.

Learned counsel representing the informant has vehemently opposed the grant of bail to the petitioner. In view of the totality of the facts and circumstances of the case, the present petition is allowed. Petitioner-Ankit Bagga, s/o Anuj Bagga, r/o B-4, South Extention, Part-II, S.S.Haus Khas, New Delhi, is directed to be released on bail, during pendency of trial of the present case, subject to his furnishing bail bond to the satisfaction of learned trial Court.
