Through this petition under Section 439 Cr.P.C., petitionerDeepak @ Deepu, has prayed for grant of regular bail in case FIR No. 151 dated 14.02.2017 registered under Section 379-A IPC at Police Station City, Jind.

According to the prosecution, in the night hours of 14.02.2017, the petitioner along with his accomplice-Rahul @ Moosa, snatched a mobile phone from complainant-Naveen Malik, make Samsung bearing three sims. Rishu Kataria 2017.11.14 16:45 I attest to the accuracy and authenticity of this document

Learned counsel for the petitioner inter alia contends that the complainant while appearing as PW-1 before the trial Court on 17.10.2017, did not identify the petitioner, thus, false implication of the petitioner is proved. Petitioner is in custody since 16.03.2017. 4.

On the other hand, learned State counsel vehemently opposed the bail to the petitioner.

Considering the overall facts and circumstances of the case, but without expressing any opinion on the merits and also that conclusion of the trial may take time, the instant petition is allowed. Petitioner-Deepak @ Deepu, is ordered to be released on regular bail pending trial, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court.
