This petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.0132 dated 7.7.2017 registered for the offence under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') at Police Station City Shahzadpur, District Ambala.

Notice of motion to Advocate General, Haryana. Mr. B.S. Virk, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.

I have heard learned counsel for the petitioner as well as learned Deputy Advocate General, Haryana appearing for the respondentHarpal Singh Parmar 2017.09.29 16:37 I attest to the accuracy and authenticity of this document Chandigarh

In the present case, there is recovery of 30 Kg. 200 Gram of poppy husk which falls in non-commercial quantity. The petitioner has been in custody since 6.7.2017. The petitioner, who is in judicial custody, is no more required for any interrogation and investigation purposes. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the final disposal of the case. Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, this criminal miscellaneous petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal bond in the sum of `30,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
