Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.98 dated 24.04.2018 under Sections 379, 467, 468, 471 IPC and Section 21 of the Mines and Minerals (Development and Regulation) Act, registered at Police Station Meharban, District Ludhiana.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the allegations against the petitioner are under Sections 379, 467, 468, 471 IPC and Section 21 of the Mines and VINEET GULATI 2019.05.02 16:39 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-36776 of 2018 -2Minerals Act. Learned State counsel has brought it to the notice of this Court that there are 14 more FIRs under Section 21 of the Mines and Minerals Act against the petitioner, which shows that petitioner is habitual offender of committing such type of offence.

At this stage, keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find that petitioner is required for custodial interrogation and no ground is made out for granting benefit of anticipatory bail to him.

Therefore, finding no merit in the present petition, the same is dismissed.
