(ORAL) Through instant petition under Section 438 Cr.P.C. prayer has been made for grant of anticipatory bail to petitioner Raghbir Singh @ Dalbir Singh in criminal complaint No.339/2007 dated 15.06.2007 under Sections 420, 419, 465, 466, 467, 468, 471 and 120-B IPC decided on 20.12.2014 by learned Judicial Magistrate Ist Class, Batala. Petitioner absented during trial against him in the aforesaid complaint case on 04.09.2012. After approximately six years, now the petitioner has approached this Court for grant of anticipatory bail to him after returning from abroad.
Learned counsel for the petitioner inter alia contends that the main complaint has been dismissed on merit. Therefore, no purpose would be achieved detaining the petitioner in jail for violating the terms and conditions of his bail bonds.
Having considered submissions made by learned counsel, but without commenting on the merits of the case, petitioner is directed to surrender before the trial Court on or before 05.09.2018 and his bail application shall be decided within next two days in accordance with law. Disposed of.
