The petitioner has been in custody for the last 3 1⁄2 years in a case registered at the instance of Surinder singh alleging that his father Gurdeep Singh has been murdered with the connivance of his mother as the petitioner had allegedly illicit relations with his mother and father of the complainant used to object to the relationship. The complainant had allegedly seen the petitioner in an objectionable condition. The body of the deceased was got recovered from the house of the deceased from the septic tank by the petitioner. The delay in disposal of the case is a matter of concern.

On asking of the court, learned State counsel informs that out of 18 prosecution witnesses, only 9 have been examined. Taking into consideration the nature of the allegations and stage of trail, I deem it appropriate to dispose of this petition with a direction that the trial court shall make earnest endevour to examine the remaining prosecution witnesses within a period of 3 months after the next date of hearing fixed before it and will try to conclude the trial within next 2 months. It is, however, directed that if possible, the trial court shall follow the provisions of Section 309 Cr.P.C. to conclude the trial, expecting that the petitioner will not hamper the expeditious conclusion of the evidence by his any act.
