This petition has been filed seeking transfer of investigation in FIR No.197 dated 22.10.2014, under Sections 376/506/354/365/511 IPC and Section 67 of the Information Technology Act, Police Station Sultanpur Lodhi, District Kapurthala to some other independent agency.

Learned counsel for the petitioner submits that a cancellation report was presented by the police authorities in this case however, the same was not accepted vide order dated 01.12.2016 passed by the learned Sub Divisional Judicial Magistrate, Sultanpur Lodhi. It was directed that further investigation be carried out in this case.

CRM No.M-35844 of 2015 -2Learned counsel for the petitioner submits that the matter has not been finalized by the police authorities till date. At this stage, he has instructions to state that the petitioner would be satisfied in case a direction is issued to the Investigating Agency to conclude the matter within a particular time frame and present the final report after further investigation. Photocopy of order dated 01.12.2016 passed by the learned Sub Divisional Judicial Magistrate, Sultanpur Lodhi, furnished in Court today is taken on record as Annexure A1 subject to just exceptions. Heard learned counsel for the parties.

Keeping in view the facts, circumstances and the limited prayer addressed, but without commenting on the merits of the case, this petition is disposed of with a direction to the concerned authorities to conclude the investigation after passing of order dated 01.12.2016 by the learned Sub Divisional Judicial Magistrate, Sultanpur Lodhi and present final report under Section 173 Cr.P.C. in the abovesaid FIR in accordance with law, within a period of three months from the date of receipt of certified copy of the order.
