(ORAL) The prayer in the present petition under Section 438 Cr.P.C is for the grant of anticipatory bail to the petitioner in case bearing FIR No.137 dated 13.09.2022 registered under Sections 379/34 IPC, 1860 (Section 411 IPC, 1860 added later on) at Police Station Verowal, Tehsil Khadoor Sahib and District Tarn Taran.
A perusal of the file would reveal that the petitioner was initially granted the concession of interim anticipatory bail by the Sessions Court at Tarn Taran. As he had not joined investigation, his bail application stood dismissed. Thereafter, he approached this Court and on 21.05.2024, the following order was passed:- "A short reply dated 21.05.2024 filed on behalf of the respondent-State is taken on record.
The learned counsel for the petitioner contends that the bail application of the petitioner was dismissed on the ground that he had not joined the investigation. He states
CRM-M-18893-2024 -2that the petitioner is ready and willing to join the investigation.
Adjourned to 25.07.2024.
In the meantime, the petitioner is directed to appear before the SHO/Investigating Officer to join investigation and in the event of his arrest, he shall be released on bail on his furnishing bail bonds to the satisfaction of SHO/Investigating Agency, subject to the following conditions as envisaged under Section 438(2) Cr.P.C.:- (i) that the petitioner shall make himself available for interrogation before the investigating officer as and when required;
(ii) that the petitioner shall not, directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case as to dissuade him/her from disclosing such facts to the Court or to any police officer;
(iii) that the petitioner shall not leave the country without prior permission of the Court and shall surrender his passport, if any."
The learned State counsel on instruction submits that the petitioner has yet again not joined investigation. In view of the incorrigible attitude of the petitioner, I do not deem it appropriate to grant the concession of anticipatory bail to the petitioner. Therefore, the present petition stands dismissed.
