(Oral) This petition under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 229 dated 19.11.2019, under Sections 379-B/34 IPC, registered at Police Station Gorayan, District Jalandhar. Learned counsel for the petitioner at the very outset submits that co-accused of the petitioner had already been granted bail by this Court vide CRM-M-15383-2020 on 01.07.2020.
As per custody certificate dated 14.10.2020, the applicantpetitioner has undergone10 months and 09 days of custody. However, there are some pending against the petitioner i.e F.I.R NO. 99 dated 05.10.2015 under Sections 21/22/61/85 of NDPS Act, F.I.R No. 08/2015 under Sections 452/454-B/323/506/34 IPC, F.I.R No. 13 dated 13.02.2019 under Sections 325/323/341/506/34 IPC and F.I.R No. 93 dated 19.05.2020 under Sections 323/148/149 IPC and 544 (1) of Prisons Act but he is on bail in all these GAURAV ARORA 2020.10.15 13:28 I attest to the accuracy and integrity of this document Chandigarh cases. However, as per custody certificate, the petitioner is not on bail in
CRM No. M-18382 of 2020 -2F.I.R No. 29 dated 26.02.2019 under Sections 22/29/61/85 of NDPS Act. In this regard, learned counsel for the petitioner has placed on record order dated 09.10.2020 passed by Judge, Special Court, Kapurthala to show that the petitioner has been released on bail in this case as well. In compliance of order dated 12.10.2020, learned State counsel has verified this fact and submits that the petitioner is on bail in F.I.R NO. 29 dated 26.02.2019.
Heard.
Keeping in view the period of incarceration of the petitioner and the fact that trial may still take some time for its conclusion, this court feels that there is no need to detain the petitioner any longer. Accordingly, this petition is allowed and petitioner is ordered to be enlarged on bail, subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Duty Magistrate, Jalandhar.
