Present petition under Section 482 Cr.P.C. for seeking quashing of order dated 28.8.2012 (Annexure P2), passed by the learned Judicial Magistrate Ist Class, Ajnala, whereby petitioner was declared as proclaimed offender.
Learned counsel for the petitioner inter-alia contended that petitioner is 78 years of age and proclamation order was not issued in accordance with law as notification of proclamation was not in order and the Court had not recorded the satisfaction while passing the impugned order. As the impugned order has been passed by the learned Judicial Magistrate Ist Class, Ajnala, petitioner can be relegated to the remedy to approach the same Court at the first instance.
