A perusal of the record would reveal that the petitioner has not joined the investigation and is absconding for the last more than 01 year whereas the report under Section 173(2) Cr.P.C. stands presented against his co-accused, who are facing trial.

As the petitioner has not joined the investigation till date, the investigation qua him is pending and the report under Section 173(2) Cr.P.C. stands presented against the co-accused, the present petition for quashing of the FIR is not maintainable at the instance of an absconding accused and, therefore, the same is, hereby, dismissed.
