M.M.S. BEDI, J (ORAL) This is second petition for the grant of regular bail, first petition under Section 167 (2) Cr.P.C., having been dismissed by this Court.

Report under Section 173 (2) Cr.P.C., indicates that though the petitioner during interrogation had made a similar statement on 17.12.2013 regarding having kept concealed pseudo ephedrine but no recovery was effected pursuant to said statement. In view of said circumstances, the culpability of the petitioner will certainly be a debatable issue. In similar circumstances co-accused of the petitioner Varinder Kumar has been granted the concession of bail by this Court.

Without expression of any opinion on merits of this case, the petition is allowed. It is ordered that the petitioner will be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court subject to the condition that he will not commit the similar offence of which he is accused of during pendency of the trial.
