(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 262 dated 08.08.2016, registered at Police Station Pundri, District Kaithal, who has been booked for having committed the offence punishable under Sections 354-B IPC (lateron Section 354-B was delted and Section 354 was added) and Section 8 of POCSO Act.

The allegations against the petitioner is that he has touched the arms and legs of the prosecutrix.

Learned counsel for the petitioner submits that the complainant is having a personal grudge against the family of the petitioner and no role has been attributed to the petitioner except the bald statement Learned State counsel on instructions stated that after framing of charges, challan was presented on 19.10.2016 and there are total 10 GAURAV ARORA 2016.10.21 16:24 I attest to the accuracy and integrity of this document

Crl. Misc. No. M-36838 of 2016 -2witnesses and none have been examined so far. The petitioner is in custody since 23.08.2016 Keeping in view the fact that the trial is likely to take some time to conclude, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Kaithal.
