SANJEEV PRAKASH SHARMA, J.(Oral) The special family pension has been granted by the Armed Forces Tribunal, Chandigarh Bench (for short 'the AFT') to respondent No.1-widow vide order dated 28.04.2023.

Learned counsel for the petitioners-Union of India assails the said order and submits that the accident on account of which the husband of respondent No.1 had expired, cannot be said to be having any casual connection with the military service.

We find that the Court of Inquiry gave its opinion that the death of the husband of respondent No.1 had occurred in military service while riding a motorcycle and going to perform his duty. Thus, in terms of the directions issued under Regulation 213 of the Pension Regulations, 1961 for the Army, we find that the AFT has rightly awarded special YAG DUTT 2025.04.07 16:56 I attest to the accuracy and authenticity of this order/judgment

CWP No.9726 of 2025 -2family pension to the widow which does not warrant any interference. 4.
