NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No. 563 dated 01.10.2023 registered under Section 4 of the Protection of Children from Sexual Offences Act, 2012 and Section 376 IPC at Police Station Sector 29, Panipat, District Panipat.

Learned counsel for the State has filed custody certificate dated 23.04.2024, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 05 months and 09 days.

Learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, with liberty to file a fresh one with better particulars.

Permitted to do so.
