Present petition under Section 439 Cr.P.C. for seeking regular bail to the petitioner(s) in case FIR No. 70 dated 17.06.2018, registered under Section(s) 323, 326, 506 & 34 IPC (Section 307 IPC was added lateron) at Police Station Bapoli, Panipat, District Panipat. Learned counsel for the respondent-State, on instructions from Mukesh, Assistant Sub Inspector, contended that the matter was fixed before the learned trial Judge for recording statement of complainant as well as all the injured persons and they have been examined by now. Learned counsel representing the complainant also contended that the matter has been compromised between the parties. Learned counsel representing the petitioner contended that petitioner is in custody since 24.06.2018, his co-accused have already been released on bail in this case and the matter has, otherwise, been settled between the parties.
Taking into consideration the facts that petitioner is in custody since 24.06.2018; other accused of this case have already been admitted to bail; the main witnesses, so far examined before the learned trial Judge, have not supported the prosecution case and no purpose will be served by keeping the petitioner in custody any further, present petition stands accepted. Petitioner is ordered to be released on regular bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Judge. (Shekher Dhawan) Judge December 04, 2018 "DK"
