Mr. Gulam Nabi Malik, Advocate respondents No.4 and 5-Punjab Wakf Board.
***** DEEPAK SIBAL, J. (Oral) 1.
Through this petition challenge is made to the order dated 12.12.2024, passed by respondent No.2, dismissing the petitioner's application filed by him to return his petition filed by him for declaring the land in dispute as a 'Muslim Graveyard' so that he could present such petition of his before the Punjab Wakf Tribunal. 2.
At the very outset, learned State counsel submits that respondent No.2 has erred in passing the impugned order dated 12.12.2024 because the petitioner's application filed by him to declare the land in question as a 'Muslim Graveyard' could only have been decided by the Punjab Wakf Tribunal as the property in question is a notified Wakf property. 3.
In the light of afore fair stand taken by the State, the impugned order dated 12.12.2024 is set aside with a direction to respondent No.2 to PRINCE SAINI 2025.08.21 22:32 I attest to the accuracy and integrity of this document
