M.M.S. BEDI, J. (ORAL) Petitioner seeks concession of pre-arrest bail in a case registered at the instance of his wife Deeksha Gupta alleging that the petitioner along with his family members had harrassed and tortured the complainant on account of demand of dowry. During pendency of the petition, the matter was referred to the Mediation Centre. It appears that the matter has been amicably resolved and the parties have decided to part company on certain terms settled between the parties. The petitioner under interim orders has already joined investigation.

Counsel for the complainant has admitted that the matter has been compromised subject to terms which also form part

CRM-M-38862-2013 (O&M) of the petition under Section 13-B of the Hindu Marriage Act, filed by the petitioner and the complainant for divorce by mutual consent. The petition is allowed. It is ordered that in case of arrest of the petitioner in this case, the petitioner will be released on bail to the satisfaction of the arresting officer subject to the following conditions: - (i) that the petitioner will join investigation as and when required;

(ii) that the petitioner will not tamper with the evidence or hamper investigation, in any manner; and (iii) that the petitioner will comply with all the terms and conditions of the compromise which find mentioned in the petition under Section 13-B of the Hindu Marriage Act, for divorce. In case of violation of any of the above said conditions, it will be open to the complainant to approach this Court for cancellation of bail.
