Petitioner has filed this petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.177 dated 09.09.2016 under Sections 406, 420 and 120-B IPC, registered at Police Station City Kharar, Tehsil Kharar, District SAS Nagar (Mohali).

Notice of motion.

On asking of the Court, Ms.Shivali, Asstt. Advocate General, Punjab, who is present in the Court, accepted notice on behalf of the respondent-State and contested the petition.

Mr.Sarju Puri, Advocate appeared and filed Vakalatnama on behalf of the complainant.

CRM No.M-36959 of 2016 -2From the record, I find that present petitioner is not named in the FIR nor any action has been attributed to him in the FIR. It is stated that during enquiry, it was found that petitioner has induced Gurmukh Singh main accused to cheat the complainant.

The petitioner is in custody since 15.09.2016. He is not required for investigation or interrogation purposes as he is in judicial custody. The trial of the case will take long time. No useful purpose will be served by keeping the petitioner in custody till the disposal of the case. Keeping in view the facts and circumstances of the present case, without discussing the facts in minute detail and without expressing any opinion on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with one surety in the like amount to the satisfaction of the trial Court/Duty Magistrate.
