(ORAL) The petition has been taken for hearing through video conference due to Covid-19 pandemic.

Present contempt petition has been filed alleging wilful & intentional violation of order dated 23.01.2020 passed by this Court in CWP-5915-2015 titled as Avtar Singh Azad Vs. State of Punjab and others by the respondents making themselves liable to be proceeded against under the Contempt of Courts Act, 1971. Learned counsel for the petitioner argues that no departmental enquiry could have been held against a retired employee, but the petitioner has been called for the enquiry by the respondents vide letters dated 22.06.2020 and 25.06.2020 (Annexures P-4 & P-6) respectively, which are in violation of the order passed by this Court on 23.01.2020 (Annexure P-1).

COCP-1281-2020 -2Ms. Deepali Puri Sandhu, Additional Advocate General, Punjab, who has joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of respondents.

Learned State counsel has placed on record the copy of office order dated 06.07.2020 today and the same is taken on record. Learned State counsel, on instructions from Ms. Harvinder Kaur, Law Officer of the respondent-Corporation, states that the respondent-Corporation is only conducting a fact finding enquiry and had written abovesaid letters to the petitioner so as to observe the rules of natural justice in case he wants to associate with the same and in case the petitioner does not want to present himself for the fact finding enquiry, he will not be forced to do so and the Corporation will implement the order passed by this Court dated 23.01.2020 (Annexure P-1) in its letter and spirit.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, recorded above, he does not want to press this contempt petition any further and the same may be disposed of having not pressed.

Ordered accordingly.

It is made clear that the respondents will be bound by their statement, recorded above.
