ARVIND SINGH SANGWAN J. (Oral) Prayer in this petition is for grant of anticipatory bail to the petitioner in FIR No.82 dated 19.09.2016 registered under Section 379B IPC at Police Station Kanwan, District Pathankot. Counsel for the State, on instructions from ASI Hem Raj, submits that the petitioner has failed to co-operate with the investigation and no recovery has been effected. Vide order dated 13.11.2017, it was made clear that in case the petitioner failed to co-operate with the investigation, the interim order shall stand vacated. Despite that fact, one more opportunity was granted to the petitioner to co-operate with the investigation. Even, the Sessions Judge vide order dated 13.09.2017 has dismissed the application for grant of anticipatory bail noticing the fact that on 03 occasions when the petitioner was granted interim bail, he has failed to join the investigation.
The same situation has been occurred in the present petition as well, thus, in view of the above and considering the fact that the allegations against the petitioner are regarding the offence punishable under Section 379-B IPC, the present petition for grant of anticipatory bail is dismissed.
