RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Bhagwant Dayal Paliwal in a case arising from FIR No.384 dated 27.07.2017 registered under Section 420 IPC at Police Station Rai, District Sonipat. According to the prosecution, Vasu Ram executed and got registered sale deed dated 21.12.1998 for a land of which he was not owner. Petitioner has scribed the said sale deed.
Learned counsel inter alia contends that petitioner is a deed writer and had only scribed the sale deed on asking of the executant without having any knowledge that he was going to commit any fraud after perusing jamabandi in favour of executant Vasu Ram. Therefore, he has no role in the commission of alleged crime. Petitioner is behind bars since 09.08.2018. Conclusion of trial may take a sufficient long time. No useful purpose would be served by keeping the petitioner in jail any more.
