Challenge in this petition preferred under Section 482 Cr.P.C. is to order dated September 30, 2014 (Annexure P-7) passed by the Judicial Magistrate 1st Class, Ludhiana, vide which an application moved under Section 311 Cr.P.C. for accepting MLR and X-Ray report of injured Jagjit Singh (Petitioner) has been dismissed. At the very outset of arguments, it has transpired that impugned order passed by the learned Magistrate has not been challenged by the petitioner before the Sessions Court. 3.

Since, an efficacious remedy by way of filing a revision petition before the Sessions Court is available, the petitioner could have availed the said remedy before approaching this Court. 4.

Accordingly, the petition is disposed of with a direction to the petitioner to avail his remedy before the Sessions Court against order dated September 30, 2014 (Annexure P-7). However, the delay in filing the revision petition, if any, shall not be a hurdle for the proper adjudication of the revision petition.
