RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Prem Nath Mittu in a case arising from FIR No.116 dated 12.07.2018 registered under Section 22 and 25 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Basti Bawa Khel, District Police Commissionerate Jalandhar. According to the prosecution, 600 tablets of Anxiolex containing salt Alprazolam and 3250 tablets of Triesr containing salt Etizolam (which do not fall under any of the two Schedules of the NDPS Act), were recovered from the shop of the petitioner on 12.07.2018. Learned counsel inter alia contends that petitioner is a wholesale dealer of drugs having license to keep and sell the drugs recovered from him.

He has been falsely implicated by the police for some extraneous reasons best known to the police or the investigating officer. Petitioner is behind bars since 12.07.2018. On the other hand, learned State counsel has not disputed the fact that petitioner is a licensed wholesale dealer of drugs, which have been recovered from his shop.

Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned.
