The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of election result dated 04.01.2026 of the Shri Aggarwal Sabha, Gurugram. He is further seeking direction to respondent No.2-District Registrar, Gurugram not to approve result of election held on 04.01.2026. 2.

The petitioner claims that he belongs to Aggarwal Community. He is member of Shri Aggarwal Sabha which is a registered society. The said society is controlled by few members. The Governing Board was not conducting elections as per Bye-Laws. CWP No.23416 of 2017 was filed before this Court on account of non-conducting of elections by Governing Board. The said petition was disposed of vide order dated 04.09.2019 on the instructions and statement of counsel for the Sabha that Governing Body would conduct election on or before DEEPAK BISSYAN 2026.03.27 14:13 I attest to the accuracy and integrity of this document

CWP-9294-2026 -225.09.2019. The elections were conducted in 2023. A period of two years passed away, however, respondent did not conduct election. The respondent substantially increased strength of members from 485 to 742 and conducted election on 04.01.2026. The respondent declared election result on 04.01.2026. All the members have been selected unanimously. It shows that there was actually no election. The respondent-Sabha has referred the matter to District Registrar for approval of the election. The petitioner has filed representations before Authorities seeking interference in the affairs of society. As per petitioner an Adhoc Committee or an Administrator should be appointed and District Registrar should not approve outcome of aforesaid elections.

Learned State counsel, on instructions from Mr. Amit Maan, HCS, Sub Registrar Firms and Industries, Gurugram, submits that as per his instructions election result stands confirmed by District Registrar on 13.02.2026.

Learned counsel for the petitioner seeks permission to withdraw the petition with liberty to avail any other alternative remedy as permissible by law.
