By virtue of the present petition under Section 483 BNSS, petitioner, who is co-accused in case bearing FIR No.33 dated 27.03.2023 registered under Sections 15-C/29/61/85 of the NDPS Act, 1985 at Police Station Khuian Sarwar, District Fazilka, has prayed for grant of bail. 2.

During the course of submissions, it was noticed that in para 13 of the petition, it had only been mentioned that petitioner is involved in 1 case apart from the present one i.e. FIR No.108 dated 02.08.2018. However, status report filed by the State clarifies that apart from the above 2 cases, petitioner is also involved in another case bearing FIR No.102 dated 24.02.2016 registered under Section 15 of NDPS Act at P.S. Gharsana, Rajasthan.

In view thereof, learned counsel for the petitioner prays for withdrawal of the present petition with liberty to file afresh. 4.
