Allowed as prayed for and original affidavit in support of compromise as Annexure P-7 is ordered to be taken on record. Main case:
1.
The present petition has been filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short-'BNSS') for quashing of FIR No. 654 dated 28.10.2020 under Sections 148,149,323,452 and 506 of IPC registered at Police Station Samalkha, District Panipat and judgment of conviction and order on quantum on sentence dated 20.02.2025 passed by ld JMIC Samlakha, District Panipat in CHI-60-2021 titled as State Vs. Raja and others (Annexure P-2) as the matter being compromised between the parties vide compromise deed dated 04.03.2025 (Annexure P-3).
-22.
Learned counsel for the petitioners has placed reliance upon judgment passed by this Court in CRM-M-6890 of 2013 decided on 01.06.2018 titled as " Mangal Dass Gautam & another Vs. State of Haryana & another" He further submits that after the conviction, the parties have entered into the compromise.
3.
Notice of motion.
4.
Mr. Aditya Pal Singla, AAG, Haryana accepts notice on behalf of the respondent-State. Learned State counsel states that no other FIR has been registered against the petitioners and they have no known criminal antecedents. 5.
Mr. Vishal Yadav, Advocate appears and accepts notice on behalf of respondent Nos. 2,3 and 4. He has filed his Vakalatnama in the Court today and the same is taken on record. He confirms the factum of the compromise having been effected between the parties and states that respondent Nos. 2,3 and 4 have no objection to the quashing of the FIR in question. 6.
In that view of the matter, even if this case is taken to its logical conclusion, it would only be an exercise in futility as the parties have already settled their differences. Therefore, no purpose would be served in wasting the time and resources of the State in pursuing this case to its pre-ordained end. It would, therefore, be better to give a quietus to the issue at this stage. 7.
Accordingly, the petition is allowed and FIR No.
