Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in FIR No.234, dated 22.08.2015, under Sections 363, 366, 376, 318, 319 and 120-B of the Indian Penal Code, 1860 and Sections 4/5 of the Medical Termination of Pregnancy Act, 1971, registered at Police Station City Taran Taran, District Taran Taran.

Learned counsel for the petitioner has submitted that respondent No.2 and the petitioner wanted to perform marriage. Complainant did not agree to perform marriage of her daughterrespondent No.2 with the petitioner. Hence, the FIR in question has been got registered against the petitioner by the mother of

Respondent No.2 is present in person alongwith her counsel and has stated that she wants to perform marriage with the petitioner and is presently residing with the family members of the petitioner.

Learned State counsel who is assisted by Head Constable Jagjit Sigh has submitted that complainant was informed qua the pendency of this case but she had refused to put in appearance before this Court.

Keeping in view the above facts, it would be just and expedient to order the release of the petitioner on bail. Accordingly, without expressing any opinion on merits of the case this petition is allowed. Petitioner be admitted to bail subject to the satisfaction of Chief Judicial Magistrate, Tarn Taran.
