(ORAL) The petitioner herein seeks the relief of regular bail in the criminal case pertaining to the FIR bearing No.250 dated 08.11.2019 registered at Police Station Shahkot, District Jalandhar Rural, under Section 306 IPC, with the allegations that she abetted her husband named Harkirat Kumar to commit suicide by pressurizing him for the dissolution of their marriage by way of divorce.

Status-report filed on behalf of the respondent-State, by way of the affidavit of Deputy Superintendent of Police, Sub Division Shahkot, District Jalandhar (Rural), is already available on the file and the same is taken on the record. The custody certificate of the petitioner, as forwarded by learned State counsel to this Court through e-mail, is also taken on the record.

learned State counsel in this petition and have also perused the file thoroughly.

Learned counsel for the petitioner contends that the petitioner is in custody in this case since 10.11.2019 and though, the Challan has already been presented in the Court but till date, the prosecution has not examined any witness before the trial Court and it being so, the petitioner deserves the relief as prayed for in this petition. Though, learned State counsel does not dispute the abovereferred factual position but she argues in view of the gravity of the offence as committed by the petitioner in this case, the instant petition be dismissed.

However, keeping in view the facts that the petitioner is behind the bars since 10.11.2019 and the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Kirandeep Kaur is ordered to be released on regular bail subject to her furnishing the requisite bail bonds and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
