It is duly accepted by learned counsel representing the various parties that the currency in question along with the vehicle has since been released on Sapurdari on the basis of orders dated 30.08.2006 by the Court of learned Sub Divisional Judicial Magistrate, Jagraon and that the articles have since been handed over to the Sapurdar after revisional Court of Additional Sessions Judge, Ludhiana vide judgment dated 30.09.2008 had decided the matter in favour of the private respondents.

Since in the light of this admitted stand, the actual currency notes having gone to the private respondents in respect of which on the orders of the Court photographs have been taken and are placed on the judicial file and Mr. Gursimran Singh, Advocate representing the private respondents though submits that his client shall not object to the exhibiting of these photographs and shall not take any objection qua them in any manner whatsoever.
In the light of these circumstances, learned counsel for the petitioner has made a statement before this Court withdrawing the present petition however, reserving rights of the petitioner to rake up all these issues, if so necessitated, during the course of trial as per law.
Allowed to do so.
The petition stands dismissed as withdrawn with liberty aforesaid. The trial Court is directed to proceed ahead into the matter as per the provisions of law.
