    2 45 &#6 This is an application for anticipatory bail in case bearing FIR No. 100 dated 27.07.2015, registered under Section 498-A IPC at Police Station Sadar, Phagwara, District Kapurthala. Parties are present. Despite the best efforts of learned counsel there seems to be no settlement.

In this case it has also transpired that in the petition filed under Section 125 Cr.P.C. by respondent No.2-wife the petitioner has not been served. Petitioner has instructed his counsel that he will not insist on formal service in the petition filed under Section 125 Cr.P.C. and will appear in the Court on the court on the next date i.e. 07.01.2016 at Phagwara. CRM-M-36205-2015(O&M) -2In the circumstances I do not deem it appropriate to deny the concession of bail to the present petitioner. Let the petitioner appear before the Investigating Officer between 10.00 AM to 04.00 PM on 26.12.2015 or on any other date on which his appearance is required by the Investigating Officer. On his appearance the I.O. shall release him on interim bail to his satisfaction subject to the conditions as envisaged under Section 438 (2) Cr.P.C. and that interim bail will be confirmed after he enters appearance in the Court on 07.01.2016. Petition stands disposed of.

Since the main case has been decided, the Criminal Misc. Application, if any, stands disposed of.
