CRWP-3805- 2023 In the present protection petition, after hearing the submission on 21.04.2023, this Court has passed the following order: "Present:

Mr. Abhijeet Partap, Advocate for the petitioner. *** 1.

Petitioner- Amit Kumar, aged 34 years has filed the present petition for seeking directions to Commissioner of Police, Ludhiana (respondent No. 2) and Deputy Commissioner of Police (Investigation), Ludhiana, (respondent No. 3) to safeguard his life and liberty from unknown attackers and callers.

Learned counsel for the petitioner submits that petitioner is running a NGO under the name of 'SAVE THE LIFE', whose motto is to provide help the poor and weaker section of the society towards any injustice caused to them. In fact, petitioner is helping the people and also helping them to curb the drug menace, which is prevalent in the State of Punjab at a very high level. Counsel also submits that petitioner and his family members have been receiving threatening calls from the Jail also, but police authorities are not taking any action. While submitting so, counsel for the petitioner refers to news items (Annexure P-2), which are appended with the petition.

For showing the nature of threats, counsel also refers to the record of whatsapp chats received by the petitioner from mobile No. RIYA 2023.05.26 17:43 I attest to the accuracy and integrity of this document

On asking of the Court, Mr. J. S. Arora, DAG, Punjab, accepts notice on behalf of respondents No. 1 to 3. 5.

This Court realizes that earlier also, in many other several petitions, allegations of receiving of threatening calls from unknown numbers have been alleged, therefore, instance of threats expressed by the petitioner in the present petition should be taken at highest level with the police station to highlight that what type of investigation is/are being done in such matter to find out the culprits and more to secure the peace and lives of the threatening call receivers in the country. 6.

Adjourned to 25.05.2023.

Meanwhile, respondent No. 2-Commissioner of Police, Ludhiana, would ensure the safety of the petitioner and his family members.

Today, counsel for the petitioner informs the Court that after filing of the present petition, petitioner has been made an accused in DDR No. 37 dated 02.05.2023 under Sections 323, 341, 506, 336, 120 B and Sections 27-54-59 of the Arms Act (later on Sections 188 and 307 IPC were also added). Thus, he seeks withdrawal of the present petition with liberty to avail alternate remedy available to the petitioner under the law. 3.

Dismissed as withdrawn, with liberty as sought and recorded here above.
