The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of assessment order dated 16.11.2023 and memo dated 27.10.2023. He is further seeking direction to reinstall electricity connection. 2.

The petitioner operates a multi-speciality hospital. The respondent-DHBVNL on the basis of checking report dated 28.10.2021 penalized the petitioner for excessive load with a penalty of Rs.41,375/-, which was deposited by him. He applied for change in category of his connection from domestic to non-domestic vide application dated 12.06.2023 and paid the charges amounting to Rs.47,425/-. The respondent issued memo dated 27.10.2023 based on LL-1 checking report DEEPAK BISSYAN 2026.03.27 14:13 I attest to the accuracy and integrity of this document

CWP-9279-2026 -2dated 05.06.2023 directing him to deposit Rs.13,01,799/- in lieu of default in payment of electricity charges. He filed complaint before District Consumer Disputes Redressal Commission (for short "District Commission") assailing demand notice dated 16.11.2023 issued by the respondent alleging theft of electricity to the tune of Rs.12,03,474/-. He in compliance of interim order dated 10.11.2023 passed by District Commission deposited Rs.3,87,806/- on 17.11.2023. The complaint was dismissed on 17.11.2025 being non-maintainable. 3.

Learned counsel for the parties are ad idem that impugned order may be set aside with liberty to pass fresh order in view of judgment dated 13.03.2026 of this Court passed in CWP-35731-2025 titled as "Rattan Singh Vs. State of Haryana and Ors." 4.
