Dated Police Station Sections 10.09.2023 Pinjore, District Panchkula 148, 149, 323, 452, 506 IPC The petitioner, arraigned as accused in the above captioned FIR, has come up before this Court under Section 482 CrPC for quashing of the FIR and all consequential proceedings based on the compromise with the aggrieved person. 2.

During the pendency of the criminal proceedings, the accused and the aggrieved person have compromised the matter, and its copy is annexed with this petition as Annexure P-3 & P-4.

After that, the petitioner came up before this Court to quash the FIR, and in the quashing petition, impleading the aggrieved persons as respondents. Vide order dated 20.04.2024, parties were directed to appear before the concerned Court for recording their respective statements regarding compromise and the Illaqa Magistrate/trial Court was directed to submit a report on or before the next date. In compliance to the order dated 20.04.2024, report from the Sub Divisional Judicial Magistrate, Kalka, has been received. In the said report it is mentioned that the complainant-injured/Dhani Ram was not impleaded as party in the present petition. 5.

Given above, present petition is dismissed with liberty to file a fresh after impleading the injured-Dhani Ram as party-respondent. However, liberty is reserved to the petitioners to file a fresh petition and there would be no necessity to re-examine the complainant/aggrieved person and the accused, whose statements stand recorded. The copies of the statements alongwith report would suffice. All pending applications, if any, stand closed.
