(Oral) This petition has been filed under Section 439 Cr.P.C. seeking regular bail to the petitioner in a case FIR No.274 dated 10.07.2016 under Section 20 of NDPS Act, registered at Police Station Ganaur, Sonepat. Learned counsel contends that recovery of 1 Kg. Charas has been effected from the petitioner, which is non-commercial in nature. Petitioner is incarcerated since 11.07.2016.

Learned State counsel has opposed the prayer for bail. Heard.

Keeping in view the period of his incarceration and the fact that the trial may take long time to conclude, no useful purpose would be served by detaining the petitioner any longer. Accordingly, petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of Chief Judicial Magistrate/Duty Magistrate, Sonepat.
