ARVIND SINGH SANGWAN, J. (Oral) The petitioners pray for grant of anticipatory bail in cross rapat No.26 dated 28.04.2018 under Sections 323, 324, 148, 149 IPC and Section 326 IPC (added later on) in FIR No.38 dated 21.04.2018, under Sections 323, 324, 326, 148, 149 IPC, registered at Police Station Dhariwal, District Gurdaspur.

The operative part of the order dated 07.05.2019, vide which interim anticipatory bail has been granted to the petitioner, is reproduced as under:- "....Learned counsel for the petitioners submits that it is a case of version and cross-version and in the FIR No.38, registered on the statement of petitioner No.1 Ramesh, he has suffered five injuries and petitioner No.2 Pawan Kumar has suffered seven injuries. Learned counsel has referred to the inquiry report dated 05.07.2018 prepared by SHO, Police Station Dhariwal, wherein it is stated that during the inquiry, it was found that no injury is suffered by the second party i.e. the MOHD YAKUB 2019.05.27 15:20 I attest to the accuracy and authenticity of this document High Court, Chandigarh

CRM-M No.17692 of 2019 complainant, as it could not be verified from the persons, who have gathered at the spot, that the injuries were caused and the complainant party has procured a false medical report.

List again on 27.05.2019...."

Counsel for the petitioners has submitted that, in pursuance to the order dated 07.05.2019, the petitioners have appeared before the Investigating Officer and have joined the investigation. Counsel for the State, on instructions from ASI Jagjit Singh, has not disputed the aforesaid fact and submits that the petitioners are no more required for further investigation. In view of the above, this petition is allowed and the interim bail granted to the petitioners vide order dated 07.05.2019 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
