AMARJOT BHATTI, J. (Oral) The petitioner - Gurmeet Singh has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in FIR No. 75 dated 27.04.2022, under Sections 354, 354-A of IPC, registered at Police Station City Moga, District Moga.
The facts of the case are that the complainant i.e. the victim filed a written complaint to the police that she was doing course of IELTS at Moga and she was staying on rent in PG, Street No. 3, New Sodhi Nagar, Zira Moga since 11.04.2022. On 13.04.2022, somebody had stolen her money and on 15.04.2022, she had gone to the office to complain to Gurmeet Singh Cheema. He started alluring her and told her that she should agree with him and he will provide her money and other comforts as provided to the other girls. She made it clear to him that she was not that type of girl. He again suggested that she should enjoy her life and she can also bring her boyfriend in the hostel. He caught hold of her hand and pulled her towards him started indecent acts. She escaped from there and LALIT SHARMA 2023.04.18 17:45 I attest to the accuracy and integrity of this document
2023:PHHC:052898 CRM-M-20779-2022 -2bolted herself in her room. He threatened not to disclose about this fact to her parents. She called her brother who reached there at 10:00 P.M. and took her along with him. Gurmeet Singh, his sons, Sandeep Kaur cook indulged in such like activities. With these allegations, present FIR has been registered.
Learned counsel for the petitioner argued that he is being falsely implicated in this case. He has relied upon still photographs of CCTV camera showing that everything was being done in a normal fashion. No such occurrence took place. It is argued that he has already joined the investigation and is not required for any other purpose. Learned counsel representing the State pointed out that the petitioner has joined the investigation and he is not required for any other purpose. It is further stated that as per ASI Sukhwinder Singh, cancellation report is being filed.
I have considered the aforesaid facts. It is clear that the petitioner has already joined the investigation and he is not required for any other purpose. It is claimed that the cancellation report is being presented. No recovery is to be effected from the petitioner. Therefore, considering these facts, the ad interim bail already granted in favour of the petitioner - Gurmeet Singh vide order dated 13.12.2022 stands confirmed, subject to the conditions as enshrined under Section 438(2) Cr.P.C. The petition is accordingly, accepted.
