In the present petition, the grievance being raised by the petitioner is that the petitioner is entitled for grant of benefit of compassionate appointment with the respondent-institution.

Learned counsel for the respondent submits that the issue raised in the present petition has already been decided by the Co-ordinate Bench of this Court while passing order in CWP-17162-2016, decided on 02.05.2024 titled 'Sukhdev Singh vs. State of Punjab and others', wherein it has been held that respondent No.2-Institute is not a State within the meaning of Article 12 being a society and the said petition has already been dismissed. Learned counsel for the petitioner has not been able to differentiate the judgment in Sukhdev Singh's case (supra) to be applicable in the present case as the same relief is being sought in the present petition. 4.
