Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.80 dated 02.04.2013 under Sections 148, 302 and 149 IPC, registered at Police Station Ladwa, District Kurukshetra.

Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that the petitioner Charan Singh is the main accused in this case and he was armed with knife. The present petitioner is in custody since 04.04.2013 i.e. for the last about 3 years and Vineet Gulati 2017.02.09 10:19 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-37215 of 2016 -210 months. The trial of this case is already complete and case is now fixed for defence and arguments but, as the cross-version of this case is stated to be at initial stage, therefore, the FIR case will not be decided in the near future.

Keeping in view the fact that the petitioner is in custody for the last about 3 years 10 months and there is no apprehension of tampering with the evidence at this stage and in view of the fact that the disposal of the case will take long time, no useful purpose will be served by keeping the petitioner in custody till disposal of the case. Therefore, finding merit in the present petition, the same is allowed. The petitioner is ordered to be released on bail subject to his furnishing personal/surety bonds in the sum of `50,000/- with two sureties in the like amount to the satisfaction of the trial Court/Duty Magistrate.
