Prayer made in the present petition is for quashing the orders dated 16.08.2005 and 14.10.2005, whereby both petitioner and respondent No.6 had equal marks, the latter being the older in age was appointed by cancelling the appointment of petitioner.

Learned State counsel makes a reference to para 4 of the written statement on merits filed on behalf of respondent Nos.1 and 2, wherein it has stated that in terms of the instructions dated 09.01.2004, where the educational qualifications of two candidates are same, the preference has to be given to one older in age. To the above facts, there was no rebuttal by filing any replication.

In view of the above, the present petition is disposed of, reserving the petitioner with a liberty to get it revived, in case lis still survives.
