Jaswant Singh,J.(Oral) Pursuant to the stand of the petitioners they have brought DD No.390209 dated 01.12.2015 for a sum of Rs.40 lacs towards return of earnest money to respondents 2 and 3. They further offer a sum of Rs.2 lacs towards interest etc for a full and final settlement between the parties based on the agreement to sell dated 19.8.2013. Mr.Babbar Bhan,counsel for respondents 2 and 3 has accepted the demand draft for Rs.40 lacs handed over to him in Court today. Photocopy retained.
Learned counsel for respondents 2 and 3 has made a statement at the Bar that he has instructions to say in the light of aforesaid development that they would draw up a formal compromise RAJINDER PRASHAD JOSHI 2015.12.19 15:56 I attest to the accuracy and authenticity of this document High Court, Chandigarh.
CRM-M 36329/2015 deed and a sum of Rs.2 lacs would be received by them at the time of quashing of the FIR in question.
In view of these developments,learned State counsel states that he has no objection if the interim bail granted to petitioners is made absolute.
Accordingly,present petition is allowed and interim protection/pre-arrest bail granted vide order dated 21.10.2015 is made absolute.
