Learned counsel for the petitioner informs that the respondent has filed an Intra-Court appeal bearing LPA-1343-2023, against the order dated 09.02.2023 (Annexure P-1), passed in CWP No.16390 of 2012. 2.

As per the order passed by the Larger Bench, learned counsel for the petitioner wishes to withdraw the present petition. However, he prays that liberty may be granted to him to file a fresh petition, in case he is still aggrieved after the decision of the Intra-Court Appeal. 3.

Dismissed as withdrawn with aforesaid liberty. 4.
