The act of having fired at Harbir, hitting him on the leg is attributed to co-accused of the petitioner Sandeep and Monu. The petitioner was allegedly driving the motor cycle at that time. The motor cycle has already been recovered. It has been found, during investigation that it was Udit in place of Monu, who was an accomplice. The petitioner having joined the investigation, can be granted the concession of pre-arrest bail.

Accordingly, the petition is allowed and interim order dated 18.11.2014 is hereby confirmed and it is ordered that in case of arrest of the petitioner, he will be released on bail to the satisfaction of the arresting officer subject to the condition that he will join the investigation as and when required by the police and will not tamper with evidence or hamper the investigation.
