(Oral) Prayer in this petition is for grant of regular bail to the petitioner, in a case arising out of FIR No. 16 dated 04.02.2016, registered at Police Station City South, District Moga, who has been booked for having committed the offence punishable under Sections 363/366/376 IPC.

Learned counsel for the petitioner submits that the petitioner and the prosecutrix were major and had gone on their own free will. Further prosecutrix in her statement under Section 164 Cr.P.C stated that she was having love affair with the petitioner and had gone along with him to perform marriage.

Learned State counsel on instruction submits that out of 15 witnesses, none have been examined so far.

The petitioner is in custody since 05.02.2016 Keeping in view the fact that the petitioner as well as GAURAV ARORA 2016.10.27 15:32 I attest to the accuracy and integrity of this document

Crl. Misc. No. M-37251 of 2016 -2prosecutrix were major and the fact that trial is likely to take some time to conclude, the present petition is allowed. Petitioner is ordered to be released on bail during pendency of the trial of the present case, subject to his furnishing bail bonds to the satisfaction of the Chief Judicial Magistrate/Duty Magistrate, Moga.
