M.M.S. BEDI, J (ORAL) Petitioner seeks concession of pre-arrest bail in a case registered at the instance of Babu Lal alleging that petitioner Deepak along with others had indulged in trespass and assault in the house of the complainant. The petitioner was attributed a rod blow on the head of Gagan. The petitioner has been in custody w.e.f. 20.3.2014. The injury attributed to the petitioner with blunt weapon is a depressed fracture of the head.
Without expression of any opinion on merits of the case, taking into consideration the fact that the petitioner has been in custody w.e.f. 20.3.2014, this petition is allowed. The petitioner is ordered to be released on bail on his furnishing bail bonds/surety bonds to the satisfaction of the trial Court subject to the condition that he will furnish an undertaking that he will not indulge in similar activity during the entire period of trial.
