The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.177 dated 9.5.2014 registered for the offence under Section 406 IPC at Police Station City Narnaul, District Mahendergarh.
I have heard learned counsel for the petitioner and have gone through the record.
The main allegation against the present petitioner is that transformers of the value of more than `11 Lacs were given to the firm of the present petitioner in the year 2010, which have not been returned back to Dakshin Haryana Bijli Vitran Nigam Limited. Learned counsel for the petitioner at the time of arguments admitted that these transformers have not been returned and are lying with HARPAL SINGH PARMAR 2015.02.09 10:33 I attest to the accuracy and authenticity of this document Chandigarh
Cr. Misc. No.M-3641 of 2015 [2] the petitioner. Learned counsel for the petitioner further argued that the petitioner will return the same.
Keeping in view the facts and circumstances of the present case, I find that as the petitioner is required for custodial interrogation, therefore, no case is made out for grant of anticipatory bail. Therefore, finding no merit in this criminal miscellaneous petition, the same is dismissed.
