PANKAJ JAIN, J. (ORAL) Claimant is in appeal seeking enhancement of compensation awarded by MACT, Hoshiarpur.

Claimant filed petition under Section 166 of the Motor Vehicles Act, 1988 seeking compensation on account of injuries sustained by her in a motor-vehicular accident, dated 25.05.2022.

It has come on record that the claimant was hospitalized on 06.06.2022 and was discharged on 09.06.2022. From medical record Exhibits A2 to A9, it is evident that she suffered fracture and dislocation of first metatarsal of left foot and fracture of 3rd 4th and 5th metatarsal. FAO No.2375 of 2024 (O&M) nature of injury was grievous. She was prescribed rest for 1 month after surgery and has been rendered crippled from running and doing heavy work for rest of her life. She was 35 years of age at the time of accident. The Tribunal awarded her lump sum amount of Rs.50,000/-. 4.

Keeping in view the disability suffered by claimant for rest of her life, that too in the foot which is the most vital limb of human body, this Court finds that the compensation needs to be enhanced to Rs.2,00,000/-. 5.

Ordered accordingly.

The interest shall abide by the award passed by the Tribunal. 7.

With the aforesaid modification in the impugned award, the instant appeal is disposed off.
