The learned counsel for the petitioner submits that since his claim for pre-mature release was considered by the State and which has been declined vide order dated 24.6.2019 during the pendency of the present petition and which has been separately challenged by way of filing CWP21093 of 2019, he may be permitted to withdraw the present petition with liberty to pursue the other writ petition, wherein the aforesaid order has been challenged.
