RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioners, namely, Sonu Mukesh and Sandeep in a case arising from FIR No.306 dated 07.09.2016 under Sections 302, 201, 147, 149 and 120-B IPC registered at Police Station Sadar, Gohana, District Sonepat.

Learned counsel for the petitioners contends that all the material witnesses have turned hostile. There is no iota of evidence against the petitioners as on today. Co-accused Raj Bala and Krishan have already been granted regular bail by this Court vide orders dated 25.07.2017 and 04.09.2017 passed by this Court in CRM-M-18753 of 207 and CRM-M30567 of 2017, respectively. Learned State counsel has not disputed the above facts. Considering over-all facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed.
